Mountains Terms of Service

Effective date: October 23, 2026 Last updated: October 23, 2026

These Terms of Service ("Terms") are an agreement between you and Twelve Twenty Seven LLC ("we," "us," or "our"). They govern your use of the Mountains mobile app, the website at themountainsapp.com, and related services (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. What Mountains is

Mountains is a family and household planning app. You can create a Hut (a household group), set Mountains (goals), plan Steps (calendar events linked to Mountains), and open the Village tab. Village is a coming-soon screen. It does not create or join a Village and it does not show Hut data. Mountains is a planning tool. It doesn't give professional, medical, legal, financial, or parenting advice.

2. Eligibility and accounts

  • Adults: you must be at least 18 years old to create an adult account, create or own a Hut, or add kid profiles. We ask for your birthday to confirm this.
  • Teens (13–17): teens may join a Hut as members with their own sign-in, with the permission of a parent or legal guardian. A parent or guardian who allows a teen to use the Service agrees to these Terms on the teen's behalf and is responsible for the teen's use.
  • Children under 13 may not create accounts. A parent or legal guardian may create a kid profile for a child (see Section 3).
  • Your information must be accurate, including your birthday.
  • Sign-in: you can sign in with Apple, Google, an email magic link, or a password. Keep your sign-in methods secure. You're responsible for activity under your account. Tell us right away at ryan.kuenneke@twelvetwentyseven.com if you think someone else has accessed it.
  • One person per account. Don't share accounts or impersonate anyone.

3. Huts, members, and kid profiles

  • Hut owners control their Hut. They can invite and remove members, re-send invitations, connect Google Calendar, transfer ownership, and manage Hut settings.
  • Transferring ownership: the owner can give ownership to another adult member who is 18 or older. The previous owner stays a member. Deleting an account does not transfer ownership.
  • Deleting an owner account: when that account is permanently deleted, the Hut is deleted, including its kid profiles, Mountains, steps, and any Google Calendar connection. Other members keep their own accounts and lose access to that Hut.
  • Deleting a member account: the Hut stays. Mountains, steps, and events that belong to that member are deleted. Kid profiles that member added are deleted.
  • Shared content: information you add to a Hut is visible to that Hut's members. Only invite people you trust.
  • Invitations: when you invite someone, you confirm you have a reasonable basis to contact them, and you ask us to send them an email on your behalf.
  • Kid profiles: only an adult who is the child's parent or legal guardian may create a kid profile. By creating one, you confirm you have that authority and that you consent to our collection and use of the child's information as described in the Privacy Policy. The Hut owner may remove a kid profile. Removal clears the display name, marks the seat removed, and keeps that profile's Mountains.
  • There is no kid session. A child cannot use the app. A parent or guardian turns on a kid profile by entering the child's name and birthday, and by confirming they are the parent or guardian. Gender is optional and may be left blank. There is no separate switch that lets the child sign in.

4. Your content

  • You own your content. Your content means the Mountains, Steps, events, notes, and other material you add.
  • License to us: you give us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display your content only as needed to operate and improve the Service and provide it to you and your Hut. This license ends when your content is deleted, except for copies in short-term backups or copies the law requires us to keep.
  • Your responsibility: you're responsible for your content and must have the right to share it. That includes information about other people, such as your children or household members.

5. Acceptable use

You agree not to:

  • break any law, or use the Service to harass, threaten, exploit, or harm anyone, especially minors;
  • post content that is unlawful, abusive, sexually explicit, hateful, or that violates someone else's rights;
  • add someone to a Hut, or create a profile for a child, without the right to do so;
  • try to access accounts, Huts, or data that aren't yours, or probe, scan, or test our systems' security without permission;
  • reverse engineer, scrape, overload, or disrupt the Service, except where the law forbids this restriction;
  • use the Service to send spam or unwanted invitations; or
  • resell the Service, or use it to build a competing product.

The Village tab does not let people outside a Hut see or exchange content. [PLACEHOLDER: if the Village tab lets people outside a Hut see or exchange content, add how to report content and block users. Apple Guideline 1.2 requires this for user-generated content.]

6. Third-party services

The Service works with third-party services, including Apple, Google (Sign-In and Calendar), and the providers listed in our Privacy Policy. Your use of those services is governed by their own terms and privacy policies. We aren't responsible for third-party services. If you connect Google Calendar, you authorize us to create, update, and delete the Hut events we wrote on the calendar you choose, as described in the Privacy Policy. We don't read your other Google Calendar events.

7. AI Assistant (if and when available)

If we offer an AI Assistant, the following applies:

  • AI-generated suggestions can be wrong or incomplete. Review every suggestion. Nothing is saved until you confirm it, and you're responsible for what you confirm.
  • Your voice or text input is sent to our AI provider (currently planned to be OpenAI) for processing, as described in the Privacy Policy. We'll ask your permission first.
  • The AI Assistant is not available, and there is no kid session that could use it.
  • Don't use the AI Assistant to process sensitive information you don't want shared with an AI provider.

8. Subscriptions, free trials, and payments

[PLACEHOLDER: billing model not final. Revise once decided. The text below assumes Apple in-app subscriptions.]

  • Some features may require a paid subscription. Prices, subscription lengths, and what's included are shown in the app before you buy.
  • Purchases through Apple: if you buy through the Apple App Store, Apple processes your payment. Your purchase is subject to Apple's terms and policies, including the Apple Media Services Terms and Conditions. We don't receive or store your payment card details.
  • Auto-renewal: subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your Apple account is charged within 24 hours before renewal.
  • Free trials: if we offer a free trial, the app will show how long it lasts and the price you'll pay after it ends. Unless you cancel at least 24 hours before the trial ends, the subscription starts and you'll be charged. Any unused portion of a free trial ends when you buy a subscription, where applicable.
  • Managing or cancelling: manage or cancel your subscription in your Apple ID settings (Settings → [your name] → Subscriptions, or https://apps.apple.com/account/subscriptions). Deleting the app or your Mountains account doesn't cancel your subscription.
  • Refunds: Apple handles refunds for App Store purchases under its policies (https://support.apple.com/118223). We can't issue refunds for App Store purchases directly.
  • Shared Hut access: [PLACEHOLDER: state whether one subscription covers the whole Hut, and what members see when a trial or subscription ends.]
  • Price changes: we may change prices. Apple will notify you of price changes as its policies require.

9. Our intellectual property

The Service, including its software, design, logos, and the "Mountains" name, belongs to us or our licensors and is protected by law. Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices you own or control, as permitted by Apple's Usage Rules. All rights we don't expressly grant are reserved.

Feedback: if you send us ideas or feedback, we may use them without any obligation to you.

10. Termination

  • You can delete your account from Profile (the icon at the top of Home, then Delete Account) or stop using the Service and sign out. Deleting does not cancel an Apple subscription. See the Privacy Policy for the 30 days before permanent deletion, and for what happens to a Hut.
  • We may suspend or end your access if you violate these Terms, if we're required to by law, or if we need to protect users or the Service. Where reasonable, we'll give notice. We may also discontinue the Service. If we do, we'll try to give reasonable advance notice so you can export your information. [PLACEHOLDER: confirm whether data export is offered.]
  • Sections 4 (license ends as stated), 9, and 11 through 16 survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT CALENDAR SYNC WILL ALWAYS BE ACCURATE OR ON TIME, OR THAT YOU WILL REACH YOUR GOALS. DON'T RELY ON MOUNTAINS AS YOUR ONLY RECORD OF IMPORTANT DATES, APPOINTMENTS, OR OBLIGATIONS.

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WON'T EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. SOME JURISDICTIONS DON'T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

13. Indemnity

You agree to defend and indemnify us against claims, losses, and expenses (including reasonable attorneys' fees) arising from your content, your misuse of the Service, or your violation of these Terms or of anyone's rights.

14. Governing law and disputes

  • These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules.
  • Informal resolution first: before filing a claim, contact us at ryan.kuenneke@twelvetwentyseven.com and give us 30 days to try to resolve it.
  • Venue: any dispute that isn't resolved informally will be decided exclusively in the state or federal courts located in Pinellas County, Florida. You and we consent to those courts' jurisdiction. Either party may bring a qualifying claim in small-claims court.

15. Apple-specific terms

These terms apply if you got the app from the Apple App Store:

  1. Acknowledgement. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
  2. Scope of license. Your license to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts in your Apple Family Sharing group may also be able to use it, as those rules allow.
  3. Maintenance and support. We're solely responsible for providing any maintenance and support for the app. Apple has no obligation to provide any maintenance or support.
  4. Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent the law allows, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs, or expenses caused by any failure to conform to a warranty are our responsibility, to the extent these Terms don't disclaim them.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it. These include (a) product liability claims, (b) claims that the app fails to conform to any applicable legal or regulatory requirement, and (c) claims under consumer protection, privacy, or similar laws.
  6. Intellectual property claims. If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
  7. Legal compliance. You represent that you aren't located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you aren't on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact. Send questions, complaints, or claims about the app to: Twelve Twenty Seven LLC, 1481 Russell Dr N, St. Petersburg, FL 33710, USA; ryan.kuenneke@twelvetwentyseven.com.
  9. Third-party terms. You must comply with any applicable third-party terms of agreement when using the app.
  10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

16. General

  • Changes: we may update these Terms. If a change is material, we'll notify you in the app or by email before it takes effect. If you keep using the Service after the change takes effect, you accept the new Terms.
  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us about the Service.
  • Severability: if any part of these Terms is unenforceable, the rest remains in effect.
  • No waiver: if we don't enforce a provision, we haven't waived it.
  • Assignment: you may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, or sale of assets.
  • Contact: Twelve Twenty Seven LLC, 1481 Russell Dr N, St. Petersburg, FL 33710, USA; ryan.kuenneke@twelvetwentyseven.com.
